Pandangan sebagian masyarakat berasumsi bahwa menurut fiqh perempuan muslim tidak memiliki kebebasan dalam menentukan siapa yang mereka harus nikahi. Pihak yang berwenang menentukan jodoh mereka adalah ayah atau wali mereka sendiri. Hal ini didasarkan pada pemahaman konsep wali mujbir (wali yang dipaksakan). Konsep wali mujbir membuat sebagian masyarakat berpendapat bahwa Islam membolehkan kawin paksa.

This paper discusses the buying and selling of credit, which has the potential to contain usury. The sale and purchase of credit are examined from the hadith's perspective about buying and selling and the hadith about usury. This paper aims to highlight the allowable and prohibited buying and selling of credit, which departs from the traditions about buying and selling and usury. By looking at what kind of buying and selling of credit is allowed in Islam, it is hoped that it can understand the public who carry out credit buying and selling transactions.

Negara Indonesia merupakan negara agraris dan tanahnya terkenal subur. Muzara’ah adalah suatu akad atau perjanjian antara pemilik tanah dan pengelola tanah untuk menggarap tanah yang kemudian hasil garapannya itu dibagi sesuai kesepakatan bersama. Adapun dasar hukum muzara’ah terdapat dalam al-qur’an dan hadits. Adapun syarat-syarat muzara’ah, ada yang berkaitan dengan orang-orang yang berakad, benih yang akan ditanam, lahan yang akan dikerjakan, hasil yang akan dipanen, jangka waktu berlaku akad, dan juga peralatan yang digunakan.

Information technology has changed the ways of transacting and opened up new opportunities in conducting business transactions. An online sale and purchase agreement via the internet is considered valid if it meets subjective and objective conditions. Trading business activities via the internet are known as electronic commerce (e-commerce). It has become a necessity that society always experiences changes which are often followed by changes in mindset and values.

The jarah contract in Indonesia is regulated by various regulations, such as the fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) and regulations from the Financial Services Authority (OJK). The fatwa and egulations are the references in the practice of contracts in Islamic financial institutions, one of which is Islamic banking. There may be a discrepancy between the practice of Islamic banking contracts and existing regulations. Therefore, this paper aims to analyze the harmonization between ijarah contract regulations in Indonesia and Islamic banking ractices.
